What are Advance Directives and Why Do you Need them?

Many people assume estate planning is only about what happens after death, but advance directives are the documents that help protect you during your lifetime if you become unable to make financial or medical decisions for yourself. In New York, the core advance directives generally include a Power of Attorney, a Health Care Proxy, and a Living Will.

A Power of Attorney allows you to appoint someone you trust to handle financial and legal matters on your behalf. Petitioners in guardianship proceedings must meet a high burden to convince a court to take away someone’s agency concerning their financial and personal matters. As such, guardianship proceedings often result in limited powers to the petitioner, unlike a broader and more comprehensive set of powers that a simple and well-planned Power of Attorney can contemplate in advance.

A Health Care Proxy allows you to designate someone to make medical decisions if you are unable to communicate your wishes yourself. A Living Will works alongside the Health Care Proxy by providing guidance about your preferences regarding end-of-life care, life-sustaining treatment, pain management, and similar decisions. These documents can provide clarity during emotional and stressful situations and help reduce uncertainty and conflict among family members.
